NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND 

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Annona.  

 

REQUEST FOR RELEASE OF FUNDS

On or about 9/21/2026 the City of Annona will submit a request to the Texas Department of Agriculture – Office of Rural Affairs (TDA-ORA) for the release of Texas Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383), as amended, to undertake a project known as Annona CDV25-0033 – water improvements, for the purpose of Administrative and Engineering Fees and Services and to rehabilitate the elevated water storage tank including interior and exterior surface and safety systems, replace the disinfection building, replace 100 linear feet of 12-inch waterline leading from the elevated water storage tank and all associated appurtenances. The water tower improvements and the waterline replacement activities are located directly northeast of the intersection of Main Street, FM 44/Main Street, and Booth Boulevard with the address of 101 Main Street. The waterline replacement will start from the north side of the water tower to approximately 100 linear feet north-northeast. The water disinfection system building activities are located approximately 31 feet north and approximately 185 feet east of the intersection of Church Street and Main Street with the address of 301 Main Street. All activities are occurring in Annona, Red River County, Texas. See project map for the area of potential effect (APE). The City of Annona has been awarded $750,000 in grant funds and shall contribute $15,000 in match funds.

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Annona has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Annona City Hall, 101 Main Street, Annona, Texas 75550 and may be examined or copied weekdays from 8:00 AM to 5:00 PM. PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Office of the Mayor. Comments may also be submitted via email to mayordeancityofannona@gmail.com.  All comments received by 9/18/2026 will be considered by the City of Annona prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.  

 

ENVIRONMENTAL CERTIFICATION

The City of Annona certifies to TDA-ORA that Marcella Dean in their capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  TDA-ORA approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Annona to use HUD program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

TDA-ORA will accept objections to its release of funds and the City of Annona’s certification for a  period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Annona approved by TDA-ORA (b) the City of Annona has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by TDA-ORA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Annessa Lewis, Environmental Review Specialist of The Texas Department of Agriculture – Office of Rural Affairs, via email at CDBG_EnvReview@TexasAgriculture.gov. Potential objectors should contact TDA-ORA to verify the actual last day of the objection period.

AVISO DE CONSTATACIÓN DE IMPACTO SIGNIFICATIVO Y
AVISO DE INTENCIÓN DE SOLICITUD DELIBERACIÓN DE FONDOS

Estas notificaciones deberán cumplir dos requisitos de procedimiento distintos, aunque relacionados entre sí, para las actividades que vaya a llevar a cabo el Ayuntamiento de Annona.

 

SOLICITUD DE LIBERACIÓN DE FONDOS

Alrededor del 9/21/2026, el Ayuntamiento de Annona presentará una solicitud al Departamento de Agricultura de Texas – Oficina de Asuntos Rurales (TDA-ORA) la liberación de fondos de la Subvención en Bloque para el Desarrollo Comunitario de Texas, en virtud del Título I de la Ley de Vivienda y Desarrollo Comunitario de 1974 (P.L. 93-383), en su versión modificada, para llevar a cabo un proyecto denominado Annona CDV25-0033 —mejoras en el sistema de abastecimiento de agua—, con el fin de sufragar los honorarios y servicios administrativos y de ingeniería, así como para rehabilitar el depósito elevado de agua, incluidas las superficies interiores y exteriores y los sistemas de seguridad; sustituir el edificio de desinfección; y sustituir 100 pies lineales de tubería de agua de 12 pulgadas que parten del depósito elevado de agua, junto con todos los accesorios asociados. Las obras de mejora de la torre de agua y las actividades de sustitución de la tubería de agua se sitúan directamente al noreste de la intersección de Main Street, FM 44/Main Street y Booth Boulevard, en el número 101 de Main Street. La sustitución de la tubería de agua comenzará en el lado norte de la torre de agua y se extenderá aproximadamente 100 pies lineales hacia el noreste. Las obras del sistema de desinfección de agua se llevan a cabo aproximadamente a 31 pies al norte y a unos 185 pies al este de la intersección de Church Street y Main Street, en el número 301 de Main Street. DECLARACIÓN DE AUSENCIA DE IMPACTO SIGNIFICATIVO

COMENTARIOS PÚBLICOS

Cualquier persona, grupo u organismo puede presentar comentarios por escrito sobre el ERR a la Oficina del Alcalde. Los comentarios también pueden enviarse por correo electrónico a mayordeancityofannona@gmail.com. Todos los comentarios recibidos antes del 9/18/2026 serán tenidos en cuenta por el Ayuntamiento de Annona antes de autorizar la presentación de una solicitud de liberación de fondos. Los comentarios deben especificar a qué aviso se refieren.

CERTIFICACIÓN MEDIOAMBIENTAL

El Ayuntamiento de Annona certifica ante la TDA-ORA que Marcella Dean, en su calidad de alcaldesa, acepta la jurisdicción de los tribunales federales en caso de que se interponga una demanda para exigir el cumplimiento de las responsabilidades relacionadas con el proceso de evaluación medioambiental, y que dichas responsabilidades se han cumplido. La aprobación de la certificación por parte de la TDA-ORA cumple con las responsabilidades que le incumben en virtud de la NEPA y las leyes y normativas relacionadas, y permite al Ayuntamiento de Annona utilizar los fondos del programa del HUD.

OBJECIONES A LA LIBERACIÓN DE FONDOS

La TDA-ORA aceptará objeciones a la liberación de fondos y a la certificación de la ciudad de Annona durante un plazo de quince días a partir de la fecha prevista de presentación o de la recepción efectiva de la solicitud (la que sea posterior), siempre y cuando se basen en uno de los siguientes motivos: (a) la certificación no haya sido firmada por el responsable de certificación de la ciudad de Annona aprobado por la TDA-ORA (b) la ciudad de Annona haya omitido un trámite o no haya tomado una decisión o emitido un dictamen exigido por la normativa del HUD recogida en el título 24 del CFR, parte 58; (c) el beneficiario de la subvención u otros participantes en el proceso de desarrollo hayan comprometido fondos, incurrido en gastos o emprendido actividades no autorizadas por el título 24 del CFR, parte 58, antes de que la TDA-ORA haya aprobado la liberación de fondos; o (d) otra agencia federal que actúe de conformidad con el título 40 del CFR, parte 1504, haya presentado una conclusión por escrito en la que se indique que el proyecto es insatisfactorio desde el punto de vista de la calidad medioambiental.  Las objeciones deben prepararse y presentarse de conformidad con los procedimientos exigidos (24 CFR, parte 58, sección 58.76) y deberán dirigirse a Annessa Lewis, especialista en evaluación medioambiental del Departamento de Agricultura de Texas —Oficina de Asuntos Rurales—, por correo electrónico a CDBG_EnvReview@TexasAgriculture.gov. Las personas que deseen presentar objeciones deben ponerse en contacto con la TDA-ORA para verificar la fecha real de finalización del plazo de objeción.
